Acceptable Use Policy

AUP (Acceptable Use Policy) – Orvixly LLC

The information provided below constitutes a legal form of agreement between you (referred to as “The Customer”) and Orvixly LLC (referred to as “The Company”), legal owner of the domain name and website www.orvixly.com (referred to as “The Website”), each referred to herein as a “Party” and collectively as the “Parties.”

Illegal Use

All services provided by The Company may be used for lawful purposes only. All applicable laws of the United States of America apply. Orvixly LLC reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.

The Customer must hold The Company harmless and risk-free from any claims resulting from the use of The Company’s services. The Customer acknowledges that The Company prohibits the use of its services for distributing, storing, or transmitting any copyrighted materials, including but not limited to copyrighted music files, photographs, books, or any other materials protected by law.

The offer, possession, or sale of such materials, including counterfeit merchandise of a trademark holder, will result in immediate termination of the account. Accounts found in violation of copyright will be instantly removed or access immediately suspended. Repeat violations will result in account suspension or termination.

Verification Procedures

We carefully evaluate new accounts to determine high-risk orders. If you are asked to verify a new account, please provide the requested information promptly to ensure your account setup is completed without delay.

Customers and End Users Are Responsible for Content

We do not review, edit, censor, or take responsibility for any content customers or End Users create. We are not liable for inaccurate, unsuitable, offensive, or illegal content or transactions. We reserve the right to refuse service to customers or End Users who disseminate material that may compromise network security or conflict with our corporate principles. This includes content that is racist, obscene, hateful, or creates abuse or customer service issues.

Use of the Service

The Customer understands and agrees that all applications, scripts, software, and actions hosted on their hosting account with The Company must comply with the following resource and acceptable use policy requirements:

Strictly Prohibited Applications / Activities:

  • Any kind of daemon processes, e.g., IRCD, BNC, proxy

  • Any type of web crawler software

  • Any software that interfaces with IRC or other relay chat networks

  • Torrent applications, trackers, or clients (linking to legal torrent websites is allowed, hosting is not)

  • Multi-Level Marketing websites

  • Cryptocurrency mining projects

  • Hosting cryptocurrency, forex, or other exchange websites

Customer Agrees That:

  • Crontab jobs must be set at intervals greater than 30 minutes; The Company may modify timing as needed.

  • Services may not be used for legal or illegal file sharing, storage, or peer-to-peer activities.

  • Websites may not contain explicit or inappropriate materials unless explicitly approved by The Company. Violations may result in suspension or termination.

  • Transmission, storage, or presentation of information in violation of law, regulations, this AUP, or ToS is prohibited.

  • No unsolicited commercial or bulk email (spam or mail bombing) may be sent.

  • No inappropriate communication to Newsgroups, Mailing Lists, Chat Facilities, or Internet Forums.

  • No unauthorized access to Orvixly’s website, servers, your hosting account, or other customer accounts.

  • No remote code execution of malicious software through the hosting account.

  • No denial-of-service attacks, port scans, or invasive procedures against Orvixly servers or other network hosts.

  • No attempts to access others’ accounts or penetrate security measures of Orvixly or third-party systems.

  • Accounts may not store copyrighted data if the customer does not own the copyright, including music, video, or software.

  • Services may not be used for fraudulent offers, financial scams, or illegal transactions.

  • Services may not be used to sell or distribute prescription drugs or illegal substances.

  • Adult content must comply with local community standards and US non-obscenity laws.

  • SSH access requires an additional verification process; customers must provide a static IP to [email protected].

Disclaimer

Orvixly LLC reserves the right to refuse or terminate the Service at its sole discretion. You understand that the evolving nature of the Internet and E-commerce necessitates that we may update this AUP at any time without notice. This AUP may not cover all possible unacceptable behaviors; we reserve the right to determine, in our sole judgment, what constitutes unacceptable activity.
